Skellig Holiday Homes - Terms and Conditions

Skellig Holiday Homes accepts reservations of holiday accommodation made by telephone, email, in person, in writing, text message, WhatsApp or online. When a reservation is made with us, by any means, our terms and conditions are deemed to have been accepted by the Booker. Any questions regarding the terms should be raised with us as soon as possible. Contact Us.

Contract:

Skellig Holiday Homes acts as an agency arranging short-term holiday rentals and acts on behalf of the property owners. The Contract for the letting of the property is between the Client and the property Owner. Bookings submitted online are provisional, and once Skellig Holiday Homes issues the confirmation form, the Contract will be entered into and becomes legally binding.

The contract is at all times subject to the Booking Conditions. The Client should check the booking confirmation form carefully as it includes the property, length of stay, charges, and other relevant booking details. The Client should notify Skellig Holiday Homes immediately in case of any discrepancy, mistake, or query.

Skellig Holiday Homes reserves the right to request full payment for bookings for special events or festivals at the time of booking. If this is applicable on-line customers will be contacted after an on-line booking is made to pay the balance of the booking deposit required. Callers who book via call centre via our reservations department will be required to pay the increased booking deposit at the point of booking.

Balance of Payment:

Full payment of holiday home rental must be made to us when the customer receives the reservation confirmation, failure to do so will result in the cancellation of you booking.

After we process your payment then you will then receive a receipt for the balance paid and details of how to collect the keys of your holiday home

Cancellation by Customer:

In the event that you wish to cancel your holiday home reservation, the following charges will apply:

On all reservations: Booking deposit is withheld except where cancellation made within 24 hours of making the booking. In such a case we will refund all monies paid less €49 to cover administration & credit card costs.

8 – 4 weeks before date of arrival: In all cases the Booking Fee is non-refundable, 50% of the total booking value (Excluding Booking Fee) is withheld plus €49 administration fee.

4 – 2 weeks before date of arrival: In all cases the Booking Fee is non-refundable, 75% of the total booking value (Excluding Booking Fee) is withheld plus €49 administration fee.

Less than 2 weeks before arrival date: The Booking Fee is non-refundable and 100% of the total booking value

We strongly advise that clients take out travel insurance to cover any costs associated with having to cancel a holiday. All refunds to credit cards incur a 2% charge for bank charges.

Each property is inspected on departure. Any queries from the Owner will be addressed in writing to the Client by the agent Skellig Holiday Homes before a charge is made. Prior notification of the charges does not stop the Guest from being liable for damage they have created.

Change of Date:

Skellig Holiday Homes may consider a request from a Client to change the dates of the booking after confirmation has been issued. The agreement will be given subject to all of the following conditions being met: if the property is available for the period requested, the request is received more than 8 weeks prior to the commencement of the rental (otherwise normal cancellation terms apply); the Client pays an administration fee of £25 (inc VAT) and any additional sums due.

Covid 19 Travel Restrictions/Government Advice:

Normal cancellation terms and conditions apply unless there is a mandatory Government restriction on travel within Ireland. Skellig Holiday Homes cannot accept any responsibility for changes in Government advice regarding travel, group make up etc after a booking is made and the onus lies with the guest to ensure they are compliant with any applicable guidelines and whether they should proceed with their booking with us. Where a guest makes the decision not to travel to their holiday home because of such advice, Skellig Holiday Homes will not be in a position to issue a refund.

Method of Payment:

We accept payment by Pay Pal or Bank Transfer. Payments by cheque or Postal Orders are not accepted.

Damages and the Cautionary Damage Security Deposit:

It is understood that the Client and their Guests will use the property lawfully, will not abuse or damage any facilities provided, and will comply with any health and safety or other policies or instructions notified to you by Skellig Holiday Homes or the Owner. The Guest will keep the Property and all furniture, fixtures and fittings at the Property in the same state of repair as at the start of the rental period. The Owner (or us acting on their behalf) may charge you for any additional, reasonable charges resulting from your stay where you have failed to comply with this paragraph. These charges are necessary in order to return the Property to its original state of cleanliness and tidiness for future bookings by other customers.

Breakages or Damages:

The Client is legally bound to reimburse Skellig Holiday Homes for replacement, repair or extra cleaning costs incurred as a direct result of the Client’s use of the

Property on demand. Reasonable charges can be incurred for, but not limited to, cleaning of furnishings, replacement equipment, keys, towels or bedding soiled beyond normal wear. The Owner of a property reserves the right to refuse further bookings as a result of previous damage.

Care of the Property:

The client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and condition and in the same clean and tidy condition at the end of the rental period as at the beginning. The Client shall abide by all instructions regarding the use of the property and its fixtures and fittings as notified by Skellig Holiday Homes.

The client shall take care not to leave personal possessions in the property on departure. Skellig Holiday Homes will make every effort to return high value items provided that the client notifies Skellig Holiday Homes within 24 hours of departure. Skellig Holiday Homes accepts no responsibility for personal possessions left in the property following departure. A charge will apply for the return of lost property.

Force Majeure:

If as a consequence of “Force Majeure”, Skellig Holiday Homes is forced to curtail, alter or cancel a holiday, we will allow you to carry forward amounts paid for Accommodation (excluding any amounts paid for Booking Fees) to another holiday taken at the same location within 12 months of your booked holiday.

We will also waive 50% of the applicable booking fee on any new booking. However, the client shall not be at liberty to maintain a claim for compensation or otherwise arising as a consequence of the said curtailment, alteration or cancellation of the holiday.

In these terms and conditions the term Force Majeure shall mean Acts of God, natural disasters, adverse weather conditions, fire, epidemics, health risks, destruction or damage to holiday accommodation, water or electricity supply issues, riots, acts of civil war, civil commotion, requisition of property, insolvency or default of any provider of the accommodation, delays due to construction, or any other reason or event which Skellig Holiday Homes acting as Agents even with all due care, could not foresee or forestall.

Pets:

A maximum of two dogs are welcome in some of our properties, and other properties are kept dog free. No pets other than dogs are permitted. Dogs are always to be properly controlled and supervised and must not be left unattended at the property. Dogs are not permitted in any of the bedrooms or on any of the furniture. Clients must clean up after all dogs inside and outside of the property, or extra cleaning costs can apply. Please be aware where a property is advertised as having an enclosed garden, this does not guarantee the garden is fully secure for all dogs.

Registered guide and hearing dogs belonging to those with visual and hearing impairments are allowed in all properties.

Guests with allergies should be aware that we cannot guarantee that there have been no dogs previously kept at the property, nor can we accept any liability for any suffering which may occur as a result of such pets having been present.

Utility Charges:

Gas, heat and electricity are included.

Mandatory Security Deposit:

A minimum refundable security deposit of €200 (per property) must be paid upon check-in to your holiday home. In some locations and at certain times of year this can increase to €500 (per property) which must be paid prior to check in of your holiday home. Refusal or inability to pay this prior to check-in is grounds for us cancelling the booking without out any refund of any monies paid to date.

Failure to leave the accommodation in a clean and tidy condition may result in the loss of all or part of your security deposit.

When a rental is for longer than one week, cleaning of the house during rental must be requested from the local Property Manager and a fee may apply.

We reserve the right to charge in advance of arrival an increased mandatory security deposit of €500 at certain times of the year for examples during festivals, during certain sporting events and New Year’s etc. You will be contacted about this prior to arrival. In the event that a customer does not wish to pay this security deposit in advance then we reserve the right to cancel their booking and retain the full amount paid for reservation.

We reserve the right to hold onto the security deposit paid in the event of the house been used for a party or event which causes inconvenience to occupants of nearby houses irrespective of whether any damage was caused to the house booked. We do not allow the staging of parties with gatherings in excess of the stated house occupation unless otherwise agreed and reserve the right to withhold the security deposit if such an event is staged in a house booked with us.

Right to Decline:

Skellig Holiday Homes reserves the right to refuse, alter or cancel a booking, even after receipt of final payment.

In addition, the company is relieved of all liability should reserved accommodation not be available due to circumstances beyond our control. In such an instance, alternative arrangements will be made in similar accommodation, or a full refund will be offered. However, no refund or liability will apply to a situation where a client is requested to vacate, or leaves of their own accord, prior to the expiration of the booking.

Behaviour:

Skellig Holiday Homes reserves the right to decline and / or terminate a booking if it believes that nature or purpose of the booking proposed by the Guests seeking to occupy a property either prior to or during a holiday is inconsistent and not suited to the nature and of location of the property and may be inconsistent with the safety, peaceful enjoyment or well-being of other occupants in nearby properties

Period of Hire:

Rentals commence from 3pm on the day of arrival and terminate by 11am on the day of departure, unless stated otherwise in writing from Skellig Holiday Homes. Guests may be permitted to extend their stay, arrive earlier, or stay later subject to availability. This must be by prior agreement in writing from Skellig Holiday Homes and can be subject to an additional charge.

Use of Property:

The number of people staying at the property must not exceed the number on the booking form. The property shall be used for personal and domestic purposes only for the duration of the rental. The property shall not be used for any commercial purposes without the consent of Skellig Holiday Homes. Skellig Holiday Homes reserves the right to refuse entry to the entire party if this condition is not observed, and generally in the case of any breach of these Booking Conditions by the Client where Skellig Holiday Homes consider such exclusion is reasonable.

Eligibility:

Skellig Holiday Homes reserves the right to refuse any bookings, in particular bookings from a) groups of people under the age of 21, b) hen or stag parties

Complaints:

Should there be any cause for complaint during the occupation of the property, Skellig Holiday Homes must be notified promptly and in case of serious problems confirmed in writing. Compensation will not be made for any complaints made after the Hire of the property has ended, or where a Client has prevented an opportunity to address a complaint during the Client’s stay.

Skellig Holiday Homes is an intermediary between the Client and the Owner of the property and will work to resolve any dispute; it cannot be held liable if one or both parties are dissatisfied with the outcome. Work taking place beyond the property boundary falls outside our responsibility, and Clients will be given prior warning where Skellig Holiday Homes are aware of potential disruption.

A complaint can be made via email at any time to info@skelligholidayhomes.com for the attention of the Directors. Should a complaint be made over the telephone, Skellig Holiday Homes may request a copy in writing.

Right of Entry:

Skellig Holiday Homes, or its contractors, shall be allowed the right of entry to the property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance. Under normal circumstances, we will always ask in advance for permission to enter.

Liability:

The following provisions set out the entire liability of (including liability for acts or omissions of its employees, agents and subcontractors) to the Client in respect of: (1) any breach of these Booking Conditions; and (2) any representation, statement or tortuous act or omission including negligence arising under or in connection with the Contract.

All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Contract. Nothing in the Contract excludes or limits the liability of Skellig Holiday Homes for death or personal injury caused by negligence or fraudulent misrepresentation.

Subject to the total of this clause: (1) Skellig Holiday Homes total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the performance of the Contract shall be limited to a sum equal to three times the rental fee; and (2) Skellig Holiday Homes shall not be liable to the Client for any type of indirect or consequential loss or damage, costs, expenses or other claims for consequential compensation whatsoever (however so caused) which arise out of or in connection with the Contract. Save for any rights under these Conditions and the Contract which may be exercised by S, no term of Skellig Holiday Homes Contract is enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to the Contract.

Without prejudice, if the property which the Client has booked becomes unavailable or unusable for the date of the booking, then Skellig Holiday Home’s obligation will be to (1) use their best endeavour to find a suitable alternative property, or failing which (2) to reimburse the Client for any monies paid. Notwithstanding any other provision of this Contract, neither Skellig Holiday Homes or the Owner shall jointly or individually be deemed to be in breach of this Contract or otherwise be liable to the Client, for delay in performance or the non-performance of their obligations, due to any circumstance beyond their reasonable control, and the time for performance of that obligation shall be extended accordingly. Force Majeure covers, without limitation, fire, flood, exceptional weather conditions, epidemics, destruction, and damage of the Property by any cause other than the negligence of the Owner or Skellig Holiday Homes, and all similar situations. No compensation, costs, or other sums of any description (including without limitation the cost of securing an alternative property/accommodation) will be payable in such circumstances by either the Owner or Skellig Holiday Homes to the Client.

Communicating with the Client:

For the purposes of the Data Protection Act 1998, Holiday at Home is the sole data controller of all personal data provided to Skellig Holiday Homes by Clients and prospective Clients. In order to process a booking Skellig Holiday Homes needs to collect certain personal data details from the Client, for example names and addresses of party members, special requirements, such as those relating to a disability or medical condition which may affect any party member’s holiday arrangements. If Skellig Holiday Homes needs any other personal details the Client will be told before they are obtained. Skellig Holiday Homes at times needs to pass these details on to other parties so that the holiday rental can be provided, for example the credit/debit card company, bank or insurance company. Skellig Holiday Homes also needs to process and store Clients’ personal details for its own administration, market analyses and operational reviews.

Skellig Holiday Homes would also like to store and use personal details for future marketing purposes (for example sending brochures or details of promotions which Skellig Holiday Homes feels may be of interest). All details given to Skellig Holiday Homes at any time will be kept, but only names, contact details and the booking preferences will be used for marketing purposes unless the Client chooses to opt out of this. Skellig Holiday Homes will respect the privacy of personal data and will comply with all relevant and current data protection legislation. Without written consent Skellig Holiday Homes will not make its mailing list or Clients’ personal data available for marketing purposes unless required to do so by a Court of Law. Competent jurisdiction will not disclose personal data to anyone. Skellig Holiday Homes can however supply promotional offers on behalf of third parties only where the Client has opted in and the offering is deemed relevant to the Client.

Warranties:

Skellig Holiday Homes does not warrant and is not responsible for the accuracy of any verbal information given or statements made by its employees, agents, or the owners of the properties.

Exclusive Offers:

Skellig Holiday Homes may from time to time offer discounted rates for last minute bookings, these offers apply to new bookings only for the dates specified on the offer and cannot be used in conjunction with any other discount. Any disputes are at the discretion of Skellig Holiday Homes.

Default by the Customer:

The consumer is obliged to ensure that all documentation and details issued to you by Skellig Holiday Homes are correct. In an unlikely event that you do not agree with the documentation, it must be brought to our attention immediately.

Bed Linen & Towels:

Bed linen & towels are supplied free of charge in all of our properties.

When a holiday home is rented for more than one week, you may liaise directly with the local Property Manager if fresh bed linen and towels are required. A fee may be required for these extra services.

Cots & Highchairs:

Cots and highchairs are available but must be booked in advance. Cot linen is not provided. Cots and highchairs must be requested at the time of booking. If you wish to order a cot(s) and/or highchair(s) please contact us by dialling or WhatsApp +353 (0)87 1309895.

Special Requests:

Requests for specific houses, etc. must be made at time of reservation and whilst we will endeavour to meet all special requests, they cannot be guaranteed. If confirmation of your reservation depends on a particular house being available, we regret we cannot accept the booking.

Disabled Persons:

It shall be the consumer’s responsibility to disclose, prior to booking, to Skellig Holiday Homes any physical or mental condition of a member of his party which may be relevant. Skellig Holiday Homes reserves the right to decline or provide a holiday for a disabled person where in our mind; the holiday home would be inconsistent with the special needs of a disabled person.

Group Bookings:

Skellig Holiday Homes does not accept bookings from groups of parties if its believes that nature or purpose of the booking proposed by the Guests seeking to occupy a property either prior to or during a holiday is inconsistent and not suited to the nature and of location of the property and may be inconsistent with the safety, peaceful enjoyment or well-being of other occupants in nearby properties unless otherwise agreed in writing.

We reserve the right to refuse to check-in such groups and will not refund any monies paid in advance in the event of non-disclosure that the booking was a Group Booking – Guests from different families travelling and staying together in one or multiple properties.

For group bookings, the refundable mandatory security deposit per house booked must be paid prior to arrival to our central reservation office. This will be refunded within 7 days of departure by our central reservation office once the local Property Manager/Owner has confirmed to us that the houses occupied were left in an acceptable condition. We reserve the right to charge an increased mandatory security deposit for group bookings of more than 1 house.

Age Restrictions:

No guest under the age of 18 can book a Skellig Holiday Homes property. Guests under the age of 18 must be accompanied by at least one person over 18 years of age.

Confirmation of Bookings:

All bookings are subject to availability. In the unlikely event of us been unable to allocate you the house that you booked, you will be given the options of either accepting an offer of alternative accommodation of a similar standard, in a similar location or a full refund of all monies paid to us. In the event of you opting to take a refund, compensation will be limited to the amount of money we have received to date.

Special Offer Terms & Conditions:

All special offers run independently of each other and cannot be used in conjunction with another offer for the same booking, therefore only one offer can be used per booking.

Changes to Our Terms and Conditions:

Skellig Holiday Homes may revise these terms of use at any time. It is the responsibility of the Client to take notice of changes made as some of the provisions contained in these Terms may supersede provisions or notices published elsewhere by Skellig Holiday Homes.
